WASHINGTON, Aug. 30 -- The U.S. Environmental Protection Agency has stated that it no longer objects to the construction, operation, and eventual closing of a geologic repository for the disposal of spent nuclear fuel and high-level radioactive waste at Yucca Mountain in Nye County, Nev. The project was analyzed in the U.S. Department of Energy's EIS (Doc. No. 20080266).

EPA wrote, "The final Supplemental EIS has addressed EPA's concerns about the language regarding EPA's radiation protection standards and the explanation of DOE's determination of the appropriate strain rates to be incorporated into the conceptual seismic model; therefore, EPA does not object to the proposed project."

The agency has requested clarification on compensatory wetland mitigation options in regard to the U.S. Department of Energy's EIS (Doc. No. No. 20080265) analyzing rail alignment for the construction and operation of a railroad in Nevada to a geologic repository (DOE/EIS-0369) at Yucca Mountain in Nye County. EPA also recommended the development/implementation of a monitoring and management plan consistent with the requirements of the Wetlands Compensatory Mitigation Rule and Army COE guidelines.

EPA does not object to the project analyzed in the U.S. Department of Energy's EIS (Doc. No. 20080264) for the Nevada Rail Transportation Corridor (DOE/EIS-0250F-S2) to the geologic repository for the disposal of spent nuclear fuel and high-level radioactive waste at Yucca Mountain in Nye County, Nev.
