Justice Department Changes Regs for Radiation Exposure Compensation Act (RECA) Claims

WASHINGTON, Oct. 26 -- The U.S. Justice Department has made two changes to the way claims filed under the Radiation Exposure Compensation Act are adjudicated.

First, DOJ will no longer enforce its regulation concerning attorney's fees whereby attorneys are prohibited from receiving reimbursement for expenses and costs above the statutory fee limits specified in the Act. Nor will Department limit attorneys from receiving reimbursement for such expenses and costs from their clients, even when a claim is unsuccessful.

Second, assuming that a claimant all other eligibility criteria are satisfied, he may satisfy the one-year statutory requirement by combining different periods of employment in uranium mining, uranium milling, and ore transporting. This amendment articulates a policy that the department has already put in place.

The notice is effective Oct. 23.
